Terms of Service

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract. By using the Service you represent and warrant that:

• You are 18 or older.

• All profile information, photos, dog details, preferences, and intentions are accurate, current, and genuine for the purpose of dog playdates and socializing with other dog owners.

• You are not prohibited from using the Service under applicable law.

• You have not been convicted of (or pled no contest to) crimes involving violence, sexual misconduct, or animal cruelty, and you are not required to register as a sex offender (or equivalent).

• You have only one active account and have not been previously removed from the Service without our express written permission.

We may suspend or terminate accounts that no longer meet these requirements.

2. Description of the Service

SwiPaws is a matching platform for dog owners. Features include profile creation (with photos of you and your dog(s)), location-based swiping/matching, in-app text messaging between matches, and tools to facilitate introductions for potential in-person dog playdates. All meetings, playdates, and offline activities are arranged and attended solely by users at their own discretion and risk. We do not organize, host, supervise, verify, or guarantee any in-person interactions or outcomes. The Service facilitates connections only.

3. Accounts, Profiles, Photos, Location, and In-App Messaging

You are responsible for your account security and all activity under it.

By uploading photos or other content (“User Content”), you grant SwiPaws a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and use it to operate, improve, moderate, and promote the Service. You retain ownership of your User Content and represent that you have all necessary rights and that it complies with these Terms.

The App requests device location access (for nearby matching) and photo library access (to select/upload profile pictures). These permissions are required for core functionality. You may manage them in device settings, but features will be limited without them.

The Service includes in-app text-only messaging between matched users. We strongly encourage all initial communications to take place through the in-app chat, as it creates a record that supports safety, moderation, and reporting. The chat does not currently support photo or video sharing.

4. User Conduct, Prohibited Activities, and Reporting

You agree to use the Service lawfully, respectfully, and in good faith, and to comply with our Community Guidelines (zero tolerance for harassment, racism, discrimination, or inappropriate/illegal content or behavior).

Prohibited activities include (without limitation):

• Harassing, stalking, intimidating, abusing, defaming, or mistreating any user or their dog(s).

• Posting or sharing illegal, obscene, hateful, violent, or infringing content.

• Misrepresenting your identity, age, dog details, intentions, or any other information.

• Using the Service for commercial purposes (e.g., breeding or sales solicitations) without prior written approval.

• Spamming, soliciting money or gifts, or sending off-topic messages.

• Impersonating others or sharing accounts.

• Scraping, reverse engineering, or interfering with the Service.

• Any activity that harms users, dogs, the community, or violates these Terms or applicable law.

Reporting: Users may report concerns about another user by swiping left on their profile from the Matches screen. Reports are sent directly to the operator for review. We investigate reports in good faith and may take action including warnings, content removal, or account termination.

False or abusive reports may also result in action against the reporting user.

Violations may result in immediate content removal, account suspension or termination (without refund), and reporting to authorities where appropriate.

5. Meetings with Other Users; Assumption of Risk, Release of Liability, and Safety Recommendations

You are solely and entirely responsible for your interactions (online and offline), communications, and any in-person meetings or playdates with other users and their dogs.

We do not verify identities, backgrounds, criminal history, health, intentions, dog temperament, training, or suitability. We perform no background checks. Communications or meetings may involve users with improper purposes.

Inherent Risks: In-person meetings with strangers (including for dog playdates) carry significant inherent risks, including but not limited to personal injury or death; injury or death to you or your dog(s); property damage or theft; animal bites, attacks, or injuries; illness or disease transmission; disputes, harassment, or assault; emotional distress; and other harms arising from the actions or negligence of other users, animals, or circumstances beyond our control.

Assumption of Risk and Release: You voluntarily assume all risks, known and unknown, associated with using the Service and any interactions or meetings resulting from it. To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue SwiPaws, its owners, operators, affiliates, officers, directors, employees, agents, successors, and assigns (collectively, “Released Parties”) from any and all liability, claims, demands, actions, damages (including personal injury, wrongful death, property damage, emotional distress, economic loss, or injury to animals), costs, and expenses (including attorneys’ fees) arising out of or related to your use of the Service, your interactions or meetings with other users, or any related activities — whether caused by the negligence of the Released Parties or otherwise — except to the extent caused by the Released Parties’ gross negligence or willful misconduct (to the extent such waiver is prohibited by law). This release is intended to be broad and inclusive as permitted by Florida law. If any portion is held invalid, the remainder continues in full force.

Safety Recommendations

(suggestions only; these do not create any duty, warranty, or guarantee on our part — ultimate responsibility remains yours):

• Meet first in well-lit, public, populated locations (e.g., busy dog parks during peak hours).

• Tell a trusted friend or family member your plans, including the other person’s profile details, exact meeting location, and expected return time.

• Keep first meetings short and supervised; consider bringing a friend or family member.

• Observe your dog’s body language and the other dog(s)’ behavior closely. Be prepared to intervene calmly or end the meeting if any dog shows stress, fear, or aggression.

• Trust your instincts. If anything feels off or unsafe, politely end the interaction and leave immediately.

• Start with low-pressure interactions via the in-app chat to build rapport before meeting in person.

• Prioritize the physical and emotional safety of all people and dogs involved.

6. Premium Subscription and In-App Purchases

Premium is an optional monthly auto-renewable subscription priced at $4.99 USD per month (plus applicable taxes; price displayed in your local currency in the App). It unlocks the Rewind feature (undo your most recent swipe) and unlimited likes. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before renewal through your Apple ID account settings (Settings > [Your Name] > Subscriptions). Billing, payments, renewals, and refunds are handled exclusively by Apple via In-App Purchase in accordance with Apple’s terms and policies. SwiPaws does not directly process payments or control refunds for subscriptions. Contact Apple Support for subscription or billing issues. We may change features or pricing with reasonable notice; continued use after changes constitutes acceptance. No refunds for partial periods except as required by Apple or law.

7. Intellectual Property, Third-Party Services, and Disclaimers

The Service (excluding User Content) and all related intellectual property are owned by or licensed to SwiPaws. You receive a limited, revocable, non-exclusive license to use the App for personal, non-commercial purposes consistent with these Terms. The Service is built using Firebase (by Google) for backend infrastructure (authentication, real- time database, storage, and analytics). Data processing by these services is subject to our Privacy Policy and Google’s applicable terms. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, non- infringement, accuracy of matches or profiles, uninterrupted operation, or safety of meetings. We do not warrant user conduct, dog compatibility, or any outcomes. Some jurisdictions limit warranty disclaimers; the above applies to the maximum extent permitted.

8. Limitation of Liability

To the fullest extent permitted by law, SwiPaws and the Released Parties shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, data loss, or personal injury) arising from your use of the Service, User Content, interactions with other users, or any meetings/playdates — regardless of the legal theory and whether or not advised of the possibility. Our total aggregate liability for any claims shall not exceed the amounts you paid to us (if any) in the twelve (12) months preceding the claim, or $50, whichever is greater. These limitations apply even if remedies fail their essential purpose. Some jurisdictions do not allow certain exclusions; they apply to the maximum extent permitted.

9. Indemnification

You agree to indemnify, defend, and hold harmless SwiPaws and the Released Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, your interactions or meetings with other users, your violation of these Terms or applicable law, or any harm to persons, property, or animals resulting from your actions or omissions.

10. Termination

We may suspend, restrict, or terminate your account and access at any time, with or without notice, for violations of these Terms, Community Guidelines, or any other reason in our reasonable discretion (including prolonged inactivity). You may delete your account at any time via App settings or by contacting support@swipaws.com. Upon termination, your license ends. Data handling upon deletion is described in our Privacy Policy.

11. Privacy

Your use of the Service is governed by our Privacy Policy, which details what we collect (including location and photos), how we use it, your rights to edit your profile and request data deletion, retention practices, and sharing with service providers such as Firebase/Google. Please review it carefully.

12. Community Guidelines

You agree to comply with our Community Guidelines (available in the App or upon request to support@swipaws.com). These include zero tolerance for harassment, racism, discrimination, or any inappropriate, harmful, or illegal content or behavior, as well as expectations for respectful and accurate conduct toward other users and their dogs.

13. Dispute Resolution

We encourage informal resolution first by contacting support@swipaws.com with details of your concern. If informal resolution is unsuccessful, and to the extent permitted by law, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Martin County, Florida (or another mutually agreed location). Proceedings will be on an individual basis only. You and SwiPaws waive any right to participate in a class action, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. Either party may pursue qualifying claims in small claims court or seek injunctive relief for intellectual property or emergency matters in a court of competent jurisdiction. This arbitration agreement survives termination of these Terms. If any part is found unenforceable, the remainder remains effective.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Florida without regard to conflict of laws principles. Subject to the arbitration provision, any legal action shall be brought exclusively in the state or federal courts located in Martin County, Florida, and you consent to personal jurisdiction and venue there.

15. Changes to These Terms

We may update these Terms periodically. The “Last Updated” date will reflect changes. For material changes we will provide reasonable notice (e.g., in-App notification). Your continued use after the effective date constitutes acceptance. If you disagree with changes, stop using the Service and delete your account.

16. Miscellaneous

These Terms (together with the Privacy Policy and Community Guidelines) constitute the entire agreement and supersede prior agreements. If any provision is held invalid, the remainder remains in effect. Failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them.
